The Anti-Corruption Commission (ACC) has been sued by Friltech Networks Zambia Limited that it sets aside the restriction notice issued on its properties in Silverest area, Chongwe, as they are not owned by Mr Francis Muchemwa.
According to documents filed in the Lusaka High Court, Friltech Networks Zambia seeks an order that the properties numbers Lot 28477/M/J and Lot 28477/M/H Lusaka Province and of certificate of titles number 99643 and 98581 respectively belong to the company and not Mr Muchemwa as per restriction notice issued by the respondent.
It is also seeking an order that the restriction notice number ACC-LUS-21-000343 issued in respect of the said properties dated the August 25,2022 be set aside for being irregular and illegal.
Friltech Networks Zambia director and shareholder, Mr Mwila Muchemwa, stated that the said restriction notice was issued to a Mr Francis Muchemwa who is not the owner of the said properties.
“That the properties seized belong to the company and not to Francis Muchemwa and cannot be detained by the respondent herein. Further the actions of the respondent are malicious as they have no investigations against the applicant whatsoever,” he said.
He said that certificates of title showed that the registered owners of the said properties at the Lands and Deeds Registry are Friltech Networks Zambia Limited.
Mr Mwila argued that the company which has been in existence for three years has a separate legal personality from that of the directors or their agents and as such it can own property in its name.
He believes the High Court had the jurisdiction to set aside the restriction notice.
