A-44-YEAR old woman of Lusaka’s Garden House area has been dragged to Kanyama Local Court for refusing to give title deeds to her client who bought a plot in 2016.
Mwenge Chanda, unemployed of Garden House was sued by Raymond Munga, 36, a car dealer of the same locality for refusing to give him the title deeds of the plot despite paying all the money.
The court heard that in 2016 Munga bought a piece of land from Ms. Chanda in Garden House area at K20,000 which was paid in installment with the first payment of K16,000 and the final payment of K4,000 was made in 2016.
Munga told the court that. Chanda had assured him that once the final payment was made, she would give him all the documents including the title deeds.
“In 2016 I was looking for land to buy when and my sister introduced me to this lady who told me she has some land for sale and upon seeing the land I was happy, we agreed on K20,000 for a 30 x 20 piece of land and I immediately paid her K16,000 as my first installment,
“But after finishing paying this lady refused to give me the title deeds and that is why I have brought her to court because I want to start building a house on the piece of land.” Munga said.
But in her defence Ms. Chanda said the reason she had been refusing to give Munga the title deed was because he was not agreeing to the demarcation.
“The reason I refused to give him papers is because he put beacons in my absence when I was out and I even told him I can pay him back his money with interest if he does not respect the agreed demarcations but he has been refusing to get the money,” she said
Magistrate Mubukwanu Matakala adjourned the matter to August 12, for judgment.
He also asked Chanda to bring all the documents related to the sale of the plot so that the court could assign someone to inspect the land.
