Police officer testifies in Sabois defamation case

A POLICE officer has told the Lusaka magistrate court that he does not know the person who posted alleged libelous comments on National Democratic Congress (NDC) leader Saboi Imboela’s Facebook page.

Mr. Davis Chimota, 47, a Police officer at Zambia National Service (ZNS) Forensic department testified that his assignment was just to copy and preserve the content extracted on a Facebook page of Ms Imboela, the NDC leader.

In this matter, Imboela, 45, of Lilayi pleaded not guilty to two counts of Libel Contrary to Section 191 of the Penal Code Chapter 87 of the Laws of Zambia. 

When the matter came up yesterday for continuation of trial before magistrate Sylvia Munyinya, Mr. Chimota in cross examination told the court that he did not know who posted the comment on Imboela page as his duty was to preserve the content extracted.

He told the court that he extracted eight Facebook link which were part of a Facebook page called Saboi Imboela -SI.

Mr. Chimota testified that the Facebook page was run by more than one administrator, who were four in number and all within Zambia and he did not know them.

In cross examination, one of the defence lawyers Melissa Phiri of Makebi Zulu advocates asked if he knew one of the administrators who wrote and posted on Facebook but in response, Mr Chimota said he would not know.

He said he recognize the person in the video he extracted on Facebook as Saboi Imboela, a public figure and a politician.

It is alleged that Imboela on September 9, 2022 jointly and whilst acting together with other persons unknown, with intent to defame, unlawfully did publish defamatory matters “Against Clayson Hamasaka on a Facebook page called Saboi Imboela-SI stating as follows “his farm is being developed by the Chinese & is the character i said had permanent rooms and hotels, sleeping with women that want jobs in the UPND. You are the ghost terrorizing women.
