Man jailed for stealing

KAPIRI MPOSHI Magistrate, Mwila Ma- lupande has sentenced a 40 year old Lu- saka based businessman to two years imprisonment for one count of theft by servant.

Edmore Chikayi who pleaded guilty as charged, has been jailed for stealing K 13,600 cash belonging to Sherperd Cham- batamba entrusted in him to procure bags of maize for the complainant.

The offence is contrary to section 278 (b) and 272 of the Penal Code Chapter 87 of the Laws of Zambia.

According to facts read before court Chikayi, on July 27, 2021 bought the maize for the complainant but resold the same maize and decided use the money as start- up capital for his roofing timber business.

In the same court, Magistrate Ma- lupande has also jailed a 40 year old man to serve a three month simple imprisonment for stealing a car battery.

Fredrick Kapepele, a gardener, stole a battery worth K 1,600 on August 12, 2021 the property of his employer, Mutale Chan- da, of Ndeke Compound.

According to the statement of facts Ka- pepele stole the battery and sold it but was later recovered.

In mitigation, Kapepele told the court he decided to steal the battery because, Chanda, his employer was not paying him enough money.

But in passing sentencing Magistrate Malupande threw away Kapepele’s mitiga- tion advising him to quit and find a better paying job stating that lesser pay should not be used as reason for one to engage in theft.
