A TEACHER of Lusaka’s Ibex Hill walked out of Chelstone Local Court two feet taller after he was cleared of adultery case since the woman involved had already been divorced from her husband.
Enoch Lungu,33 a businessman of Chainda Compound had sued Cliff Phiri,29, a teacher of Ibex Hill on allegations that he destroyed his marriage with his ex-wife hence wanted compensation.
Senior magistrate Charity Milambo dismissed the claim on grounds that the marriage Lungu’s marriage had already ended.
“You are already a divorced couple therefore a claim of compensation for causing adultery cannot pass,” said Magistrate Milambo
“This man caused my divorce with now my ex-wife, about two years ago I caught pictures of him with my wife holding each other and her sitting on the man’s laps,
“I confronted my wife but she denied. We sat down as a family and everything was cleared because I had to forgive her so that we stay together in harmony,” he said Lungu
Lungu said recently this year before the divorce he caught wife again with love text messages in her phone from the same man.
“We quarreled and that’s how she went to her parents’ place only to receive a summon for divorce,” said Lungu
Lungu further said that he wanted to be compensated because Phiri broke his home of nine years with his wife.
But Phiri denied the allegation saying Lungu’s wife was his workmate and there was nothing else between them.
“Her ex-wife is my colleague, we work together and those photos he saw we took them on Womens International Day when we went for a march past and about text messages, I don’t know anything,” he said.
And key witness who is Lungu’s ex-wife said nothing was going on between them, and those pictures he was talking about were taken at the Womens International Day, at a public place.
Court then found out that the marriage had already ended and both were free people.
