Mother, son ordered to pay K4, 000 virginity damages

THE Lusaka Boma Local Court has ordered a 16 year old boy and his mother to pay K4, 000 for damaging a girl’s virginity.

This is in a case in which Theresa Daka, of Kabanana compound sued the boy of Linda Compound for damaging her daughter’s virginity.

Daka told Senior Court Magistrate George Kaoma that towards the end of 2018 she discovered that her daughter was pregnant.

On being told who was responsible for the pregnancy, she summoned the juvenile for a meeting where he radily accepted responsibility. 

“At the time his mother was in South Africa. His grandmother who I was in contact said if my daughter was pregnant, her grandson was not the one responsible,” Ms Daka said.

She told the court that in February, they met to discuss the way forward but the boy’s family stopped communicating with them and there was no sign that they would approach them.

“For damaging my child who is just in Grade 10 and has even stopped going to school, I want this boy to pay me K18, 000,” Daka said.

The juvenile told the court that when he met with his girlfriend, , he accepted responsibility and while they were looking for money to start paying for damage, they just received the summons.

The boy’s mother, Janet Phiri told the court that when she was informed that her son had impregnated a girl, she was not around but made arrangements to travel back. 

“My mother went to see those people and my son didn’t deny that he was responsible. We kept waiting for the girl’s family but they didn’t come and we failed to approach them again,

 “My BP actually rose and I was in hospital after we received the summons because I thought maybe my son would even be arrested,” Phiri said.

She told the court that they were willing to pay for damage but it was a huge shock to them to receive the summons because they had no problems with Daka and her family. 

The court found that both the boy and his girlfriend were too young to be involved sexual acts.

Magistrate Kaoma then ordered the boy to pay K4, 000 as damage.
