A POLICE officer of Lilayi, Abel Sosala, 48, has been ordered by the Boma Local Court to settle K4, 200 debt incurred by his niece after he acted as guarantor.
This was a case in which Saulosi Daka, 44, a businessman told Senior Presiding Magistrate that he did not know Sosala well but he had given his wife K5, 000 which she gave to her business partner Gloria.
‘She gave her friend Gloria the money and ran away to South Africa in 2015. I phoned her and she always said she would bring the money until her phone stopped going through,
“We only met her by chance in 2018 at town centre and took her to police. When the police questioned her, she said she would pay the money,’ said Daka
He also told the court that Gloria phoned her uncle who came to the police and there he promised that the money would be paid back in two instalments and Gloria she was released.
However, no money was paid back even after the agreed dates.
Sosala then told the court that after he received a call that his niece had been detained, he went to the police station and negotiated with the police and his niece was released.
“We discussed with Daka and we agreed that the money would be paid in two instalments. We even signed an agreement that by end of April, the whole amount would have been settled. Unfortunately, when we wanted to raise the money, Gloria lost her father and because of funeral costs, we failed to raise the money. I explained what happened to Daka who seemed to understand,” said Sosala
He also said his niece told him she had sent Daka K800 via Airtel money and to confirm, she forwarded the message to him.
“From then, she told me she sent him another K400. I later stopped seeing my niece. I just heard she had gone to South Africa again and Daka kept calling me to ask about the money. Next thing I received was a summon,” said Sosala
Daka only acknowledged receiving the K800 and not the K400.
After some investigations, the court found that there was insufficient evidence that the K400 was sent.
Magistrate Sichone then ordered Sosala to pay the K4,200 balance in two instalments.
