Vulgar neighbour fined K5,000

Diana Nsofwa writes

A LUSAKA retiree has been fined K5,000 by the Matero local court for telling lies about a married woman to her husband, claiming that he had slept with her.

Ruth Momba, 33, of Apollo sued Fred Kangomba, 50 for accusing her of having sex with him.

The two were appearing before magistrate Pauline Nema.

Momba told the court that Kangomba and her husband are friends and that while she was awar in Ndola with the children, he told her husband while drunk that he had had sex with her.

“My husband called me saying that Kangomba told him that we had been having sex.  I failed to go back home because he told me that if I didn’t go and buy court summons I should not go back there,” said Momba.

Momba’s husband Lewis Muvumbo,40, stood as a witness and told the court, that the incident took place last week Tuesday 2 April.

“Kangombo came to my house and we went out to drink. He started shouting at 3 men and after he was done he turned to me and said I have been sleeping with your wife. He said that in front of people.  I got my phone to call my wife and he ran away.  The men I was sitting with said Kangombo had the habit of destroying people’s marriages and that I was not the only person,” said Muvumbo.

“I went to his house and his wife started shouting at me saying she too had heard about it and Kangombo stood up wanting to fight with me but instead I left him. A few days after he sent someone to come and apologize saying he was drunk,” said Muvumbo.

In his defence, Kangombo told the court that Muvumbo called him to drink on his own.

“When we were out drinking Muvumbo told me that he heard my wife and I do not have sex that is how I got upset and said that’s why you fight with your wife. Otherwise I did not say anything else said Kangombo “.

“Talking whilst drunk is not good, if you know you cannot control it, do not drink. In other words you admire how Muvumbo and his wife live. You will compensate her with K5,000 so that you stop talking anyhow,” said magistrate Nema.
