Marketeer fined for dating neighbour’s hubby

A marketeer in Ndola has been fined K1,000 for insulting a woman whose husband she was having an affair with.

Victoria Phiri 24 was fined for compensation of insults and having an affair with Mervis Labule`s husband.

They are both residents of Main Masala township.

Ms Labule,30, told the court that last year people used to tell her that Ms Phiri was dating her husband but did not want to believe.

This is because she took Ms Phiri as her young sister since they were neighbours.

Ms Labule said one day she met Ms Phiri and asked if she could use her phone since hers had a battery low.

She said Ms phiri refused to give her phone saying it was not hers and did not have a sim card.

But when Ms Labule asked if she could use her phone battery, the sim card fell and Ms Phiri quickly picked it and chewed it.

“When I asked her why she chewed the simcard, she said she was dating my husband and she did not want me to find out about it as there was information on the card,” she said.

The case was before Kabushi local court senior presiding magistrate Agnes Mulenga sitting with Mildred Namwizye with Evelyn Nalwizya.

Ms Lubule told the court that Ms Phiri apologised and being older, she forgave her.

Ms Labule said a few months later, she found Ms Phiri hugging and kissing with her husband behind a bar.

She said when her husband saw her he ran away and that  she grabbed Ms Phiri and beat her.

“She reported me to the police and I was locked up for two days and I was then asked to pay Ms Phiri with K300,” she said.

She said from the time she paid her the money, Ms Phiri insulted her each time they met.

Ms Labule said Ms Phiri told her that she was not going to stop sleeping with her husband and that if she touched her, she would report to the police so that she could pay her again.

“I am tired of her insults, first she has destroyed my marriage by getting involved with my husband and she continues to disgrace me in public,” she said.

In her statement, Ms Phiri said she did not date Ms Labule’s husband but that he used to ask her out and she had refused.

Ms Phiri said she explained everything to her but she did not understand and just kept on telling her to stop dating her husband.

She said one day, Ms Labule found her with her friend at a bar and started asking her where her husband was because she suspected he was with her.

“I told her I did not know where her husband was but she did not believe me and that was how she started beating me,” she said.

She said she then decided to report her to the police and that was how she was apprehended and was told to pay K300.

Ms Phiri said from the time she was paid K300, Ms Labule kept on insulting her and embarrassing her at the market that she was a prostitute.

In passing judgment, the court ordered Ms Phiri to compensate Ms Labule K1,000 for insulting her after committing adultery with her husband.

The court further ordered the two parties to live in total peace for three years.
