AN 18-YEAR-OLD Somali national who has been dragged to court in Lusaka for violating the virginity of a grade 10 girl and impregnating her has been fined K7, 200 in damages.
Esnart Phiri, 37, of Kalundu compound sued the juvenile offender for impregnating her daughter, Brenda Phiri, 20, two years ago.
Phiri told Senior Court Magistrate Miyanda Banda at Matero Local Court that the boy impregnated her daughter in 2016 when she was doing her grade 10 and has a child who was now one year and seven months old.
She explained that when they sat to resolve the matter the boy pleaded that he should not be charged a lot of money because he would take Brenda back to school. He was then charged K10, 000.
“The boy has been giving excuses after he paid only K1, 800,’’ said Phiri.
In defence, the juvenile who admitted the charge said that he did not discuss the issue with Phiri but Brenda’s grandfather who died two weeks ago and that he paid K3,100 and produced a signed document to that effect.
Asked by Phiri if he would take Brenda back to school, the boy said that he would if she so wanted, adding that he was in fact the one encouraging her to get back to school.
In her submission, Phiri said that she wanted the boy to finish paying the K10, 000 he was charged and take Brenda back to school.
The court ordered the boy to pay Phiri K7,200 which included costs, with initial payment of K1,000 followed by monthly instalments of K300.
On taking Brenda back to school, the court said that was a private arrangement because she knew what she was doing when she had sex with her boyfriend.
