MUSA MWENYE TO SUE UPND MP MABETA

Musa Mwenye SC, former chairperson of the Anti-Corruption Commission (ACC), has threatened legal action against Heartson Mabeta, UPND Kankoyo Member of Parliament, for allegedly begging US$3 million in the Copperbelt Energy Corporation (CEC) versus Konkola Copper Mines (KCM) matter.

Mr. Mabeta, in a statement on Facebook, implicates Mr. Mwenye in purported threats directed at Judge Charles Kafunda, presiding over the aforementioned case.

Mr. Mwenye has consequently demanded an immediate retraction and a suitable apology from Mr. Mabeta for the defamatory assertion.

Failure to comply with these demands will result in Mr. Mabeta facing legal consequences.

Mwenye & Mwitwa Advocates, legal representatives of Mr. Musa Mwenye, have issued a demand to Mr. Heartson Mabeta, requiring a retraction of his defamatory statements. According to Mr. Mwenye’s demand letter, dated July 21, 2024, Mr. Mabeta made allegations via a Facebook post claiming that Mr. Mwenye sought an improper US$3 million commission from Copperbelt Energy Company Plc, a publicly listed company obligated to ethical standards.

The demand letter asserts that Mr. Mabeta also falsely accused Mr. Mwenye of intimidating Judge Charles Kafunda. Mr. Mwenye refutes these accusations, emphasizing his unblemished 25-year career as a lawyer without any disciplinary actions from the Law Association of Zambia.

The letter highlights Mr. Mwenye’s credentials as a senior lawyer and State Counsel, previously serving as President of the Law Association of Zambia, Solicitor General, Attorney General, and Chairperson of the Anti-Corruption Commission (ACC).

Furthermore, the demand insists that Mr. Mabeta’s statements were made with malice and lack any substantiating evidence. It stipulates that Mr. Mabeta must issue a suitable apology within 24 hours and retract the defamatory post, or face legal action.

“Our client’s distinguished career and international reputation have been unfairly impugned by your baseless accusations,” the letter concludes, underscoring Mr. Mwenye’s parliamentary ratifications and roles on reputable international boards, as well as his past duties for the Commonwealth.
