LUSAKA lawyer has sued another lawyer in the Lusaka High Court demanding a payment of over K200, 000 after a failed partnership.


Mr Cheelo Mwiinga of MAK Partners Legal Prac- titioners wants Mr Alex Musanya, practicing under Zambezi Chambers to pay K39,000 being a refund erro- neously paid to the defend- ant (Mr Musanya) .


Mr Mwiinga is also claiming a payment of K30,000 per month for the seven months Mr Musanya has been illegally holding on to his vehicle a Mitsubishi Pajero totaling K210,000 for the seven months.


He also wants restitution of motor vehicle registration number AJD 8823 and interest on the stated amounts.
In a statement of claim, Mr Mwiinga stated that in 2013, he entered into a verbal agreement to partner in a law firm called Zambezi Chambers which was initially owned by Mr Musanya.


After working together for a year, Mr Mwiinga claimed that the duo could not continue with the partnership for various reasons.
Mr Mwiinga stated that months later after they separated, Mr Musanya accused him of misappropriating both clients’ and law firm’s funds and decided to report to the Law Association of Zambia (LAZ).


He said that LAZ through the Legal Practitioners Com- mittee heard the complaint and advised the two parties to settle the matter amicably and take a report to the Committee.


“The plaintiff shall state that after the failed discus- sion with the defendant the Legal Practitioners’ Committee decided to suspend the practicing licence for the plaintiff in February, 2017,” he stated.

Mr Mwiinga stated that after the ruling of the Legal Practitioners’ Committee, which was erroneous and therefore misleading , he committed to pay Mr Musanya K100,000 for his practicing licence to be restored.
He claimed that he paid K39, 000 and surrendered his Mitsubishi Pajero as collateral to Mr Musanya.
