A Truck Driver accused of stealing a Bicycle told the Choma Magistrates Court that the Bicycle went with the person whom he had sent to buy Beer.

David Liyunda ,30, who seemed shaken in the Dock continuously admitted to stealing the Bicycle despite his explanation telling a different story.
In this matter Liyunda is charged with Theft contrary to section 272, Chapter 87 of the Penal Code of the Laws of Zambia.
Allegations are that on July 3, 2020 in Choma stole one Bicycle valued at K1,000 the property of Mike Mudenda.
When he appeared for plea before Magistrate Muyambango Munukayumbwa, the accused person admitted the offence but his explanation twisted the Courts arm to record a plea of not guilty.
Court: Have you understood the charge read to you?
Liyunda: Yes
Court: How do you plead?
Liyunda: I admit.
Court: Did you take the said Bicycle?
Liyunda: Yes
Court: Did the owner allow you:
Liyunda: NO
Court: Did you have any claim of right?
Liyunda: No
Court: What did you intend to do with it?
Liyunda: I sent someone with the same borrowed Bicycle to buy beer, but that person went with it for good.
Court: so, you didn’t steal it.
Liyunda: I stole it.
Court: Youngman you are changing gears now, what was your intention again?
Liyunda: I gave it to my boy to go and buy beer but he went for good.
Court: I record a plea of not guilty.
Liyunda: But am the one who got the Bicycle from………
After entering an equivocal plea of not guilty, the matter was adjourned to October 8 for trial after Senior Prosecutor Alex Syulikwa made the application.
Liyunda was remanded in custody.
