Man convicted despite DEC taser claim

THE Nakonde Magistrates Court has convicted the 23 years old man who accused Drug Enforcement Commission Officers of planting cannabis in his house and further electrocuting him with a Taser Gun.

Resident Magistrate George Banda convicted Elias Chilesheafter establishing that his defence could not hold water as it was just an afterthought.

In this matter, Chileshe stood charged with trafficking in 5.8grammes of Marijuana a herbal product of Cannabis Sativawithout lawful authority or medical recommendation.

The incident happened on 26th May 2020 in Nakonde district.

When the matter came up for judgement in Court, Magistrate Banda disputed Chileshe’s innuendos that the drugs were planted in his house by DEC officers as he saw them enter the house, and there was enough lighting.

The Court thus convicted Chileshe after being satisfied that the prosecution had proved their case beyond reasonable doubt.

Despite Chileshe pleading for lenience and stating that he went to Nakonde in search of a living, the Court slapped him with 6 months imprisonment with hard labour with effect from date of arrest.

The convict was informed of his right to appeal to the High Court within 14 days if he felt aggrieved with the outcome.
