The Boma Local Court in Lusaka has granted divorce to a couple of Libala South due lack of trust and jealousy in their marriage.
This was a case in which Bwalya Malama sued Stella Nyau for divorce alleging that she was unfaithful.
Malama told senior local court magistrate Linda Tembo that the two married in 2009 and went on operation later because his wife was unfaithful but they got back together in 2017.
“One time she went to Botswana for two months and switched off her phone so we did not communicate the whole time. I found out she had been communicating with her parents and that is how I managed to reach her,” Malama said.
He said one time his wife received a message from the man and when he called the man back, he admitted to being his wife’s boyfriend and apologized to him.
“She receives many suspicious messages I don’t even say anything anymore. She comes home very late between 22.00 or 24:00hrs. There is no love and no sex in the house because when she comes late, she wears tights and a chitenge before getting in bed, implying that they’ve already finished her where she’s coming from,” Malama said.
He said he wanted divorce because he was just being tortured in the marriage.
In defence Nyau equally told the court that she wanted a divorce because she lived in physical and mental torture from her husband.
“He found me working as a teacher. I was chased from my work place because he would always come to monitor me at and start calling me a prostitute. They told me ‘kamone ichupo kunganda’,
“He’s cost me many jobs and doesn’t even support me when I stop working,” Nyau said.
She said her husband often threatened to kill her and the children and locked her out when she came home from work at 19:00hrs.
“My child started stealing maize to take to the neighbour for her to be allowed to watch TV at their house. I pleaded with my husband to bring back the TV. He says anything to my parents and doesn’t respect them, even tells me ‘go and buy talk time mba shoute ba wiso naba noko’,
“I don’t enjoy sex with him because he’s very rough. He slams me against the wall and even our neighbours know that’s it’s happening in here. Even for him to give me K150 for my hair, he tells me ‘pali iyi impiya wala bomba’. He forces himself on me and ripped many of my pants and clothes in the process,” she said.
The court granted the couple divorce and ordered Malama to compensate Nyau with K2, 000.
