NATION BREWERIES, EMPLOYEES SUED

NATIONAL Breweries Limited and its employee have been sued by a mini bus owner who is demanding K300 per day for damages caused to his motor vehicle through alleged negligent driving.

Emmanuel Chilembe dragged Vivian Mutale and National Breweries Plc to the Lusaka High Court claiming that he is the owner of a Toyota Hiace, registration number ALV 3192, which was damaged beyond repair after being hit by an Isuzu van belonging to the brewing company.

According to a statement of claim filed in the Lusaka High Court, Mr Chilembe says that his vehicle was being used for public transport and that he has suffered loss of business which is K300 per day from March 2 this year and that he has lost K54, 000 to date.

“The plaintiff’s motor vehicle, Toyota Hiace, was extensively damaged beyond repair in the accident which was caused by Ms Mutale who failed to stop the vehicle on the road and hit the plaintiff’s vehicle that was parked at John Laing bus stop,” says the claim.

“At the time of the accident, the plaintiff was using the said vehicle as a public transporter and the plaintiff from March 2 2019 has suffered loss of business equivalent to K300 per day which as at date of writ is K54, 000,” read part of the claim.

He said that the particulars of negligence are that Ms Mutale was driving too fast, failed to control the motor vehicle and to keep a look out for other road users.

And now Mr Chilembe claims an order of payment of K110, 000 being the value of the motor vehicle which was damaged beyond repair, and K54, 000 as special damages, and order for payment of K300 per day from the date of writ until final payment.

He also wants interest, cost and any other reliefs the court may deem fit.
