A CARE taker has been sued by his lover’s mother in the Chilenje Local Court for failing t6o settle arrears of K3,000 for damaged.
Munyapekwa Liyali, of New Kasama, sued her daughter’s lover, Justin Zimba, 38, of State Lodge.
The two where appearing before senior local court magistrate Ackim Phiri sitting with presiding local magistrate Patrick Nyirenda.
“It was in 2013 when we sat down because he had damaged my daughter and he had accepted the charge. When she gave birth we asked him to pay K500 and two cows, but he only paid the K500,” Liyali said.
He said Zimba promised that he would pay but since 2014 he had not, but impregnated his daughter again.
Since the second pregnancy Zimba had been quiet.
“That’s why I came to court. He says he does not have the money.
So, we decided to put the cows in money form and it adds up to K3,000. We do not want him to be following her because she is not staying with him. They are not married, and if another man comes to marry her we will marry her off. If he wants to marry her let her come and pay,” Liyali said.
Zimba said he had not refused to settle the claim.
“I met Liyali’s daughter in 2010, and I impregnated her. We sat down to talk. They wanted to give her to me, but my family asked them to wait for me to settle. After she gave birth she went to the village but failed to stay there,” Zimba said.
He said the girl was working for a white woman when she came back to Lusaka. The employer did not want someone with a child.
So, she was fired and had nowhere to go.
“I was forced to stay with her. I used to get paid K750. That is why I was unable to finish the payment,” Zimba said.
He said he deferred paying because his mother in-law wanted to visit them.
“I wanted to build her a house. Now I am getting more money. I will finish paying,” Zimba said, “but my wife is no longer with me we have an issue”.
The court proved the claim of K3,000 and ordered Zimba to pay the first instalment of K1,000 on September 12.
