THE Boma Local Court in Lusaka has ordered a Congolese to compensate a woman of Chamba Valley with K7,000 for damaging her daughter’s virginity.
Winfreda Kalunga, 37, has taken Peter Peto, 27, to court for deflowering her daughter.
Kalunga told senior local magistrate Silvia Kabunda he impregnated her daughter twice and had not shown commitment to pay damage.
“Peter is my son-in-law. He impregnated my daughter in 2016. She was in grade eight at school and he got her and impregnated her,” Ms Kalunga said.
“We called him and sat as a family to discuss the way forward. We charged him K12,000 for damage and dowry, of which he paid K1,000,” she said.
Her daughter had not gone back to school since then and she wanted Peto to pay her the balance of what her family had charged him.
Peto, however, said he had not been charged for damage but only dowry for marriage.
“When her daughter got pregnant, they wanted to charge me for damage but I refused and told them I wanted to marry her. So, they agreed and only charged me K6,000 which was for dowry and we paid a K1,000,” he said.
“They gave me the girl and I stayed with her. Due to some financial difficulties I had, her mother gave us somewhere to stay. She told her mother that I was playful. So, the mother chased me. But she is still my wife and I paid dowry of which I was charged, not damage,” he said.
Peto said he was not going to pay for damage because he was only charged dowry.
The court still found him wanting and ordered him to pay K7,000 for virginity damage.
