A KAFUE wife who sued her husband for divorce walked away empty handed because the Boma Local Court decided compensation was not necessary in the application.
Sally Mbafuta, 45 Dennis Goma, 54,of Mtendere East for divorce
The two were appearing before magistrate Linda Tembo sitting with Fridah Mugala.
The two got married in 1988 and have two children.
Mbafuta told the court she wanted to divorce because Goma had another wife and they had been on separation for 3-4 year’s.
“We came to Lusaka from Mufulira in 1994 because he had stopped work. He married me when I was in grade 8 and he made me stop school. We sold our house in Kafue to buy the one in Mtendere East,
“Our problems started when he brought another woman into our home and every time we would argue he would say that it was his house. Our daughter once caught him having sex with another woman,” Mbafuta said.
At one he told her that he had found another woman who was in employment and she (Mbafuta)was not his type
In defence Goma told the court that Mbafuta would pick up a call and speak romantically to another man.
“Our separation came about because she had answered her phone and left me in the sitting room and she was talking to a man romantically on October 24 2014, I was even eavesdropping. We stayed up to November without talking after that,” said Goma
“She asked for forgiveness over the phone issues that is when I chased her. We had a meeting but she refused to come back. We have come a long way in our marriage I don’t want it to end, it’s better the Devi I know than the Angel I don’t know,” said Goma”.
Bu court said it could not force a marriage on people and granted divorce with be no compensation because you have both moved on.
It however rules that all goods and property acquired together should be shared equally.
