A-10 YEAR OLD girl has revealed in the Choma Fast Track and User Friendly Court for Gender Based Violence that she saw the black manhood of the 41 years old farmer who indecently assaulted her older sister.
This is in case in which Fenbal Kapole of Choma’s Siachitema area is accused of indecent assault contrary to section 137 Chapter 87 of the Penal Code of the Laws of Zambia.
Particulars of the offence are that on June 20 in Choma Kapole unlawfully indecently assaulted a woman.
When the matter came up for trial before Resident Magistrate Ethel Phiri, the 10 years old girl who witnessed the act told the court that on the date in question she and her sister were sent to buy cooking oil around 19.00hours when they found the accused at a beer hall.
“We found Kapole at a beer hall and he asked us if we wanted money, my sister said yes and he told us to go to a nearby village where he would find us”.
“When he came my sister spread a chitenge on the ground, Kapole removed his manhood and put my sister on his laps after undressing her, they then fell together on the ground and started having sex” she said
The girl said after what she saw, she rushed home and told her grandfather who quickly came and found the two had finished but took them to the hospital.
And according to the grandfather’s testimony Kapole tested positive to the HIV Virus.
In cross examination Kapole asked the girl if she could describe his manhood as she claimed to have seen it.
The girl in her response said she saw it as there was good moonlight and it was black.
The accused person then insisted that he shows his manhood to the court because it had different features and when his wish was granted the police officer who saw it confirmed that it was black and circumcised.
The matter comes up on August 13 for continued trial and Kapole was remanded in custody.
