Violent, unfaithful couple advised to divorce

A COUPLE that came to the Boma Local Court seeking reconciliation has a rude shock of its life when the court instead advised either party to sue for divorce because of insurmountable violence and unfaithfulness in its marriage.

Moses Sinkamba of Chipata Overspill sued his wife Nema Nampungwe of the same compound for reconciliation.

The two got married in 1991 and had 10 children but four have since died.

Sinkamba told magistrate Sylvia Kabangwe that problems started in 2016 when Nampungwe started denying him sex.

“In November 2018 a strange number called her when I asked who it was she said it was her friend, since that day she would leave me in bed in the morning saying she has gone into town and when I go to town I wouldn’t find her,

ā€œMy children told me that she has a boyfriend and they even gave me the number and when I checked her phone I found it was the same number that used to call her,ā€ he said

He said when two argued over the matter he slapped her and blood started coming out from her nose and she reported him to the police.

ā€œI spent a night in the cells, when I was released she told me that the house was her brothers so she would leave and I decided to leave instead with two of our children and went to Kabwe,

ā€œI would visit her occasionally and on June 2 2019 I found another man coming out of her room and when I asked what he was doing he said he was a doctor. I did not do anything to the man but I called our neighbors to witness,ā€ he said

Sinkamba said he now has another wife but he still loved Nampungwe who he wanted to keep for the sake of the children.

But Nampungwe told the court that they had a traditional marriage but in 2012, he started calling her a prostitute and had no respect for her.

She said Sinkamba went to Mpulungu with his lover and got sick and she got all the household goods and ran away from him but his sister called her to nurse him but she refused.

ā€œOne night I heard a knock on my door and found him in a bad state. He had gone to the village and married his brother’s wife,he called for a family meeting and asked for forgiveness but I refused because his brother died of AIDS,

The court observed that there too many problems in the marriage including unfaithfulness.

ā€œYou came to court once for reconciliation and it failed.. You do not love her, we stay in marriage because of love, reconciliation has failed either party can sue for divorceā€ said Magistrate Kabangwe
