Adulterous man fined K3,000

A LUSAKA local court has ordered a 34-year-old man to compensate his workmate K3,000 for committing adultery with his wife.

Senior magistrates Mubukwanu Matalaka and Esther Mulomba at Kanyama Local Court ordered Jacob Musonda of Kanyama, 34, to compensate Daniel Zimba, 32, of Jack Township for committing adultery with his wife, Dorothy Mwansa, 28.

Zimba told the court that he married Mwanza in 2016 and that they have one child.

He paid dowry.

Zimba said Musonda was his workmate at Avic International where he was working and that he was at the farm in March 2019.

When he returned home at 21:00 hours he was shocked to find Musonda with Mwansa naked in the bedroom.

Musonda’s motor cycle was also inside the house.

Zimba said he got Musonda’s clothes and took him and Mwansa outside for people to see before taking them to the police.

In defence, Musonda said Zimba was his workmate but he owed him some money.

Musonda said on the fateful day he phoned Zimba to go and get the money but it was Mwansa who was communicating with him and directed him to his house.

Musonda said when he reached Zimba’s house Mwansa told him to park his motorbike inside because there were thieves.

He said Mwansa wanted to buy talk time to call Zimba to bring the money, but shortly Zimba arrived and started to accuse him of sleeping with his wife.

Musonda denied being found in the bedroom saying he was in the sitting room waiting for Zimba.

Mwansa testified that Musonda had been her boyfriend since January 2018.

At first they made love in the matrimonial home last month when Zimba went to visit his father at the farm.

“Musonda has been giving me money. The other time he wanted to make love to me at an unfished shop but later he just gave me K50,” she said.

Mwansa testified that when they were caught in the bedroom by Zimba she was not expecting him and that Musonda was in a pair of shorts without a shirt, and that she had removed her top.

Passing judgment, the court said Mwansa had revealed that Musonda had been her boyfriend since January 2018 and that at first they made love in her matrimonial home.

It was the second time Zimba they were found together.

The court said Musonda had failed to challenge Mwansa and wondered how he had put his motorbike inside the house if he had only gone to collect money.

Musonda was ordered to compensate Zimba K3,000 in monthly instalments of K1,000.
