HIV positive woman wins back her household goods

RABECCA BANDA writes

A Lusaka man has been ordered to return household goods he got from his former lover who is HIV positive.

Daniel Mpanzi,47, of Kalingalinga was sued by Beatrice Banda, 45, of Kalikiliki compound for the return of goods

Banda said that they had been cohabiting for ten years and recently separated because Mpanzi was disrespectful and exposed her in public of being HIV positive.

She complained that Mpanzi did want to give her the goods that were hers.

“I want the court to help get my household goods from him, I want everything that I bought with my own money,” she said.

The two were appearing before senior local Court magistrate Ackim Phiri sitting with presiding local court magistrate Patrick Nyirenda.

In defence Mpanzi said disputes started when he discovered that the Banda was taking ARVs and that’s how he decided to get her things from the house.

“I did not chase her,  she left on her own.  She took her clothes together with my underwears which she has not returned until now,” he said.

“I said I have no hand in the properties because they are for the children. I never refused her to get her share of household good but not until I know my HIV status because she lied to me,” he said.

“I will not give her the household goods but we will share equally,” he said.

But the court ordered Mpanzi to release the household goods belonging to his former lover.
