Cohabiters denied divorce application

A LUSAKA woman has lost a claim for divorce in the Boma Local Court because dowry was not paid for her marriage
Boyd Mwambula, 40, of Ng’ombe Compound was sued for divorce by his wife of seven years Juliet Tembo,33 a maid of the same locality.
Tembo explained that they got married in 2013 but her husband did not pay dowry.
“I want to divorce my husband because he does not respect me in our house. He has a lot of girl friends some of them even call to insult me,
“During the time I was in labor in hospital and delivered our second child. I called him to bring money I needed for the baby but he gave excuses,” Tembo said.
She said when she eventually got home she found Mwambula drunk and was trying to hide some condoms from her.
“He sold part of his farm and was paid K5,000 down payment and did not leave any money for food. He is very stubborn and has refused to apologise for insulting me and my parents,” Tembo said.
The two were appearing before presiding senior local court magistrate Sharon Sichone sitting with Magistrate Mpundu Mwape.
In defence Mwambula confessed that he loved his wife and did not want them to be divorced.
“I don’t want our marriage to end because I love her and also for the sake of our two children but if she insists then klet the marriage end,” Mwambula said.
The court dismissed the divorce claim saying the two were not married but cohabiting.
