Man accused of committing adultery paid K1, 000

A CHILENJE Local court has fined a man K1, 000 for falsely accusing another man of committing adultery with his wife.

Before Magistrate Hildah Choonya sitting with magistrate Ackim Phiri was Philemon Mapulanga who sued Benson Chipote for committing adultery with his wife Ailess.

Chipote told the court that two weeks ago as he was coming from church his wife went to buy something from a nearby shop and delayed to return.

“When she came home she told me that she delayed because she met Mapulanga who told her that I ended his marriage”.

“Since that day Mapulanga has been telling everyone he meets that I ended his marriage yet his wife has never been my girlfriend. I am married and I have come to court because I want compensation for this false accusation” said Chipote

Mapulanga told the court that he married Ailess in 2013 but went on separation in December 2018, adding however that people kept telling him that she and Chipote were lovers.

“On February 16 I found Chipote at my wife’s ntemba I did not say anything but people at the tavern told me to wait for 20:00 hours I would find him with her,

“I went to her house at 21:45 and I peeped through her bedroom window I saw the two naked bodies on her bed, I went back home and called for the headman who advised me not to go back there because a fight would break out,” said Mapulanga

He later met Chipote’s wife and asked her if her husband slept at home the previous night and she said that he did not.

He then proceeded to tell her what was going on and she confirmed that her husband has a girlfriend.

But the court dismissed the matter due to lack of sufficient evidence to prove the case.

Magistrate Phiri said the concerned parties were supposed to sit down and resolve the issue before allowing Ailess to live in another house.

He told Mapulanga he have procured good evidence or shouted for help

“You made a mistake because you didn’t call for witnesses, you will compensate Chipote with K1,000,” said Magistrate Phiri.
