No sex leads to divorce

A LUSAKA man who continuously denied his wife sex has been divorced.

Gibson Shampakalisha, 29, of Ng’ombe was sued by his wife of five years for denying her conjugal rights.

Margaret Phiri, 25, also of Ngombe, had sued her husband after he stopped  sleeping with her even though they were living in the same house.

Phiri complained that her husband did not allow her to come near or touch him.

“Tinkala munyumba imodzi monga ndise brother na sister (we are living like brother and sister),,” she said.

She also said that her husband been threatening to kill her on many occasions which made her fear for her life.

Phiri told the court that because of these threats on her life, she decided to move out and stay with her parents.

The two were appearing before Justices Linda Tembo and Prudence Bwalya.

In his defence, Shampakalisha said his wife had been spending too much time at her parents’ house and did not cook for him.

He however, pleaded with the court not to grant a divorce because their child needed them to be together.

The court granted divorce saying they could not force the woman to be in a marriage where she had no conjugal rights.

The couple was advised to share the property equally but the man would pay K500 to support the child.
